GENERAL TERMS AND CONDITIONS OF SALE

1.1All orders for products from FruitFrais.ch or one of its affiliates are governed by these Terms and Conditions of Sale, which will apply to the exclusion of all other conditions.

1.2The general terms and conditions of sale will be communicated during each order validation process, the registration of your order is subject to acceptance. By placing an order you acknowledge that you have read, understood and accepted, without reservation, these General Terms and Conditions of Sale.

1.3 FruitFrais.ch reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on this website. Registering your order is subject to acceptance of the terms of sale, every order placed after the publication by FruitFrais.ch of the new version of its General Terms and Conditions of Sale implies acceptance of them.

4.1 FruitFrais.ch is not bound by the presentation of the products on its website. By placing an order on this site, you submit an offer in which you engage on the one hand to buy the products that you selected and on the other hand in which you agree to the Terms and Conditions.

4.2 The orders you place with FruitFrais.ch on this site are submitted for certain products, with minimum durations.

4.3 Orders for trays and box gifts are not tacitly renewed  each week, unless otherwise specified by you on info@fruitsfrais.ch.
5.1 FruitFrais.ch will send you a confirmation of your order email. This email constitutes our acceptance of your order and is the conclusion of the contract of sale or subscription between you and FruitFrais.ch. In other words, the orders you place on this website do not constitute a binding contract as long as they have not been confirmed by a FruitFrais.ch

5.2 FruitFrais.ch reserves the right, at its discretion, to refuse an order or subscription, particularly in cases of unpaid invoices or insolvency or failure to comply with delivery terms.

5.3 The data recorded by FruitFrais.ch constitutes irrefutable proof of the order or transaction. The data recorded by the payment system constitutes irrefutable proof of financial transactions.
6.1 The price payable (in Swiss francs - CHF) for the goods you order are those contained on this website on the date of the order, plus VAT.

6.2 FruitFrais.ch reserves the right to change prices at any time.
7.1 For FruitFrais.ch subscription services, these are established for a definite or indefinite period, depending on the type of service selected. For fixed term subscriptions, the notice period is 10 days before the first deadline, failing which the subscription will be automatically renewed for an indefinite period

7.2 For indefinite period subscriptions, the notice period is 10 days.

7.3 For any changes or cancellations of deliveries, it is imperative to warn us before noon of the Thursday preceding the delivery to cancel or change, otherwise the order will be charged.
8.1 All orders confirmed by FruitFrais.ch will be delivered to the address indicated on the order.
9.1 It is up to you to take care to check the amount and the conformity of the goods on delivery.

9.2 If you find that merchandise is missing or has been damaged, you must inform FruitFrais.ch with in 3 days of delivery.
10.1 The customer becomes responsible for products once delivered, even if they are left at the door or at a neighbor in their absence.

10.2 Complaints about the quality of delivery are accepted within 1 day of receipt of the goods.
11.1 Invoices are  monthly and payable in ten days.

11.2 Credit card payment is due immediately. The data of your credit card is encrypted for security reasons.

11.3 By checking the box "I authorize the monthly charging of my credit card" you allow FruitFrais.ch to charge your credit card according to the number of boxes delivered monthly.
12.1 Any delay in payment will result in the removal of default interest on the outstanding balance and the allocation of administrative and legal costs incurred.

12.2 FruitFrais.ch reserves the right to refuse an order until payment of the full balance due.
13.1 The photographs and texts illustrating and describing the products contained on this site are not contractual and solely for informational purposes. FruitFrais.ch assumes no responsibility for errors or omissions in the photos or texts appearing on this site.

13.2 Subject to the mandatory Swiss law, no claim for damages relating to a delivery covered by these conditions can exceed the amount of the purchase price of the products that led to the request for damages.

13.3 In no event can FruitFrais.ch be held liable for indirect, incidental or consequential damages of any kind arising in connection with its products, their use, sale or this site.
14.1 FruitFrais.ch will do its utmost to fulfill its obligations but can not be held responsible for delays or failure to deliver caused by circumstances beyond its control, such as accidents, strikes, wars, natural disasters or others that prevent the production, transportation or delivery of products.

14.2 In case of delay, FruitFrais.ch will fulfill its obligations as soon as possible and reserves the right to postpone the delivery day in exceptional circumstances.
15.1 Regardless the nature of the personal data concerning you which we are led to read, whether we are entitled to ask for it in accordance with these terms of sale, or whether we register it in an automated way, we are committed to make every effort to treat it with the utmost confidentiality, ensuring its protection and making use of it only to complete your requests or improve the services which may be offered to you.
16.1 This website uses Google's retargeting service (or remarketing) which allows Google, thanks to the use of cookies, to identify visitors who have been on our site and submit them to online advertisers once that they left the site. 17.1 PAYMENT WITH INVOICE WITHIN 14 DAYS with our Partner SWISSBILLING. SWISSBILLING SA is a service provider, that allows you to receive your order with an invoice in a simple and secure way. The Invoice will be sent from SWISSBILLING separately from your order, per email or regular mail, depending on your choice. SWISSBILLING’s services are based on a fix fee and your maximum order is CHF 850.00. The invoice is payable within 14 days. For security matters, shipping address and billing address must be identical. SWISSBILLING keeps the right to have a credit check control done through it’s partner CRIF AG in Zurich (Tél.: 0848 333 222, www.crif.ch) .

18.1 These General Terms and Conditions are governed by Swiss law.

18.2 The Parties agree to Lausanne as the exclusive place of jurisdiction.
